Terms of Service
1. Acceptance of Terms
By downloading, accessing, or using the Elevate Interview application ("Application," "Service," or "we"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Elevate Interview. We recommend reading them carefully before using the Application.
2. Description of Service
2.1 What We Offer
Elevate Interview is a job interview practice and preparation platform that uses artificial intelligence to:
- Provide interview questions across various categories and difficulty levels
- Allow recording or typing responses to practice questions
- Generate automated feedback on your responses
- Evaluate multiple communication dimensions (Clarity, Completeness, Confidence, Engagement, Conciseness)
- Track your progress over time
2.2 Nature of Service
The Service is solely for practice and personal improvement. Elevate Interview:
- DOES NOT guarantee results in real interviews
- DOES NOT provide professional human resources or career advice
- DOES NOT represent any employer or recruiting company
- DOES NOT evaluate your actual suitability for specific positions
AI-generated feedback is for guidance purposes and should be used to complement your preparation, not as a substitute for practice with professionals or mentors.
3. Eligibility
3.1 Age Requirements
To use Elevate Interview you must:
- Be 18 years of age or older, or
- Be above the legal age of majority in your jurisdiction
We do not permit use by minors. If we discover that a user is underage, their account will be terminated immediately.
3.2 Legal Capacity
By using the Service, you represent that:
- You have legal capacity to enter into binding contracts
- You are not prohibited from using the Service under applicable laws
- You will comply with these Terms and all applicable laws
4. User Accounts
4.1 Registration
To access Service features, you must create an account using:
- Apple Sign-In (Sign in with Apple), or
- Google Sign-In
You agree to provide accurate information and keep it up to date.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your access credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We are not responsible for losses arising from unauthorized access to your account when such access results from your negligence.
4.3 One Account per User
Each user may maintain only one account. Creating multiple accounts to evade restrictions or abuse the Service may result in termination of all associated accounts.
5. Plans and Subscriptions
5.1 Free Plan
The free plan includes:
- Limited access to 3 practice sessions per day
- Basic feedback features
- The limit resets daily at midnight (local time)
5.2 Premium Plans
We offer the following subscription options:

5.3 Free Trial Period
IMPORTANT - READ CAREFULLY:
- We may offer a 3-day free trial period for new users
- During the trial period, you will have full access to Premium features
- At the end of the trial period, you will be automatically charged the selected subscription price, unless you cancel before the trial period ends
- Only one trial period per user is allowed
- To cancel, you must do so through your Apple ID subscription settings at least 24 hours before the trial period ends
- After the trial ends (if not converted to Premium), you receive 3 additional free sessions before reverting to the daily limit
5.4 Payment Processing
- All payments are processed by Apple through the App Store
- Charges are made to your registered payment method in your Apple ID account
- We do not have access to your financial information
- Prices include applicable taxes based on your jurisdiction
5.5 Automatic Renewal
Subscriptions renew automatically:
- Monthly: Each month on the same date
- Annual: Each year on the same date
You will be charged within 24 hours prior to the end of the current period.
5.6 Cancellation
You can cancel your subscription at any time:
- Open Settings on your iOS device
- Tap your name > Subscriptions
- Select Elevate Interview
- Tap Cancel Subscription
Effects of cancellation:
- You will continue to have Premium access until the end of the paid period
- No additional charges will be made after the current period
- At the end, your account will revert to the free plan
5.7 Refunds
Refunds are subject to Apple's policies:
- To request a refund, you must contact Apple directly
- We cannot process refunds directly
- Refund requests are evaluated on a case-by-case basis according to App Store policies
6. Acceptable Use
6.1 Permitted Uses
You may use the Service to:
- Practice interview question responses
- Improve your professional communication skills
- Track your personal progress
- Prepare for job opportunities
6.2 Prohibited Conduct
You agree NOT to:
- Inappropriate content: Include offensive, discriminatory, defamatory, obscene, illegal, or threatening content in your responses
- False information: Provide false information about your identity or credentials
- System abuse: Attempt to manipulate, hack, or overload the Service
- Restriction evasion: Create multiple accounts to evade limits or restrictions
- Reverse engineering: Decompile, disassemble, or reverse engineer the software
- Unauthorized commercial use: Resell, sublicense, or commercialize the Service
- Interference: Interfere with Service operation or other users' experience
- Data collection: Extract, collect, or store data from other users
- Rights violation: Infringe intellectual property rights or third-party privacy
6.3 Monitoring and Moderation
We reserve the right to:
- Monitor Service usage to detect violations
- Review reported or suspicious content
- Remove content that violates these Terms
- Take action against accounts that violate these Terms
7. Account Suspension and Termination
7.1 Termination by User
You can delete your account at any time from the Application Settings. When you delete your account:
- Your personal data will be deleted according to our Privacy Policy
- Active subscriptions must be cancelled separately in the App Store
- This action is irreversible
7.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if you:
- Violate these Terms of Service
- Include abusive, illegal, or inappropriate content in your responses
- Attempt to abuse or manipulate the Service
- Engage in fraudulent activities
- As required by law or competent authorities
7.3 Effects of Termination
Upon termination of your account:
- Your access to the Service will be immediately revoked
- Your data may be deleted according to our Privacy Policy
- You will not be entitled to refunds of payments made
- Confidentiality and intellectual property obligations will survive
7.4 Appeal
If you believe your account was terminated in error, you can contact us at support@elevate-interview.com. We will review your case, but reserve the final decision.
8. Intellectual Property
8.1 Our Property
Elevate Interview and all its content, including but not limited to:
- Source code and software
- Design and user interface
- Logos, trademarks, and trade names
- Interview questions and editorial content
- AI algorithms and models
- Documentation and materials
Are owned by Elevate Interview or its licensors and are protected by intellectual property laws. All rights reserved.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, and revocable license to:
- Download and install the Application on your personal devices
- Use the Service for your personal, non-commercial use
- Access content available through the Service
This license does not include the right to modify, distribute, sell, or create derivative works.
8.3 Your Content
You retain ownership of the responses and content you provide. However, by using the Service, you grant us a license that is:
- Non-exclusive to process your content
- Royalty-free to generate feedback
- Limited to the purpose of providing the Service
We may use aggregated and anonymized data to improve our algorithms and services.
8.4 Feedback
If you provide us with suggestions, ideas, or feedback about the Service, you grant us the right to use such information without compensation or obligation to you.
9. Disclaimer of Warranties
9.1 "AS IS" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
9.2 No Guarantee of Results
Specifically, we DO NOT warrant that:
- Using the Service will result in success in real interviews
- AI feedback will always be accurate or appropriate
- The Service will be available without interruption
- Errors will be corrected immediately
- The Service will meet your specific expectations
9.3 AI Limitations
Artificial intelligence has inherent limitations:
- It may generate inaccurate responses occasionally
- It does not replace professional human judgment
- Results may vary between users
- Evaluations are for guidance, not definitive
10. Limitation of Liability
10.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATE INTERVIEW SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Damages resulting from your use or inability to use the Service
- Content or conduct of third parties on the Service
- Unauthorized access to your transmissions or data
- Any other matter related to the Service
10.2 Liability Cap
SINCE ALL TRANSACTIONS ARE PROCESSED BY APPLE THROUGH THE APP STORE, ANY REFUND REQUESTS MUST BE HANDLED DIRECTLY WITH APPLE IN ACCORDANCE WITH THEIR POLICIES.
ELEVATE INTERVIEW DOES NOT PROCESS PAYMENTS OR REFUNDS DIRECTLY. OUR LIABILITY IS LIMITED EXCLUSIVELY TO THE PROVISION OF THE SERVICE WITHIN THE APPLICATION.
10.3 Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Elevate Interview, its affiliates, directors, employees, and agents from any claim, damage, obligation, loss, liability, cost, or debt, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of third-party rights
- The content you provide through the Service
12. Modifications to Service
12.1 Changes to Service
We reserve the right to:
- Modify or discontinue Service features
- Introduce new features or content
- Change free plan limits
- Update or improve AI algorithms
We will attempt to notify you of significant changes with reasonable advance notice.
12.2 Price Changes
Subscription prices may change. If we increase prices:
- You will be notified at least 30 days in advance
- The new price will apply to your next billing period
- You can cancel before the new price takes effect
13. Modifications to Terms
13.1 Updates
We may modify these Terms periodically. When we make material changes:
- We will update the "Last Updated" date
- We will notify you through the Application or by email
- We will post the new Terms on our platform
13.2 Continued Acceptance
Your continued use of the Service after posting modified Terms constitutes your acceptance of such changes. If you do not agree to the new Terms, you must stop using the Service.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elevate Interview regarding the Service.
14.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Failure to exercise any right under these Terms does not constitute a waiver of that right.
14.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
14.5 No Agency Relationship
Nothing in these Terms creates an agency, partnership, employment, or franchise relationship between you and us.
15. Governing Law and Jurisdiction
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Mexican States, without regard to its conflict of laws provisions.
15.2 Dispute Resolution
Any dispute related to these Terms or the Service shall be resolved as follows:
- Direct negotiation: The parties will attempt to resolve the dispute amicably for 30 days
- Mediation: If negotiation fails, the parties will participate in mediation
- Arbitration or courts: If mediation fails, the dispute will be submitted to competent courts or arbitration as appropriate
15.3 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIM WILL BE FILED ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION.

17. Apple App Store Specific Terms
17.1 Acknowledgment
You acknowledge that these Terms are between you and Elevate Interview only, not with Apple Inc. Elevate Interview, not Apple, is solely responsible for the Service and its content.
17.2 Scope of License
The license granted is limited to a non-transferable right to use the Service on any Apple-branded product that you own or control, as permitted by the App Store Usage Rules.
17.3 Maintenance and Support
Elevate Interview is solely responsible for providing any maintenance and support services. Apple has no obligation to provide any maintenance or support services.
17.4 Warranty
In the event that the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). Apple has no other warranty obligation.
17.5 Product Claims
Elevate Interview, not Apple, is responsible for addressing any claims related to the Service, including:
- Product liability claims
- Claims that the Service fails to meet legal or regulatory requirements
- Claims under consumer protection or similar legislation
17.6 Intellectual Property
In the event of any third-party claim that the Service infringes intellectual property rights, Elevate Interview, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
17.7 Legal Compliance
You represent and warrant that:
- You are not located in a country subject to U.S. government embargo
- You are not listed on any U.S. government prohibited or restricted parties list
17.8 Third-Party Beneficiaries
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
These Terms of Service have been prepared to comply with Apple App Store requirements and applicable regulations.
